Foreign Intelligence Agency - The Head of the Foreign Intelligence Agency



Within the limits of his rights and duties, the Head of the Foreign Intelligence Agency:
  • issues orders, rulings, commands, guidelines and directions specifying the modus operandi of the Foreign Intelligence Agency;
     
  • by means of orders, vests organizational units of the Foreign Intelligence Agency with organizational rules and regulations specifying the internal structure and specific tasks of those units;
     
  • within his competence and in accordance with the needs, may establish or appoint units of either a permanent or ad hoc character, collective consultative and advisory organs, as well as may establish, reorganize, and close training centres of the Foreign Intelligence Agency;
     
  • runs the Foreign Intelligence Agency directly or by deputies, as well as with the assistance of the directors of particular bureaus; furthermore, he may authorize subordinate functionaries to handle matters on his behalf, within a defined scope;
     
  • submits the application to the Prime Minister for appointing and dismissing the deputy heads of the Foreign Intelligence Agency;
     
  • provides the Prime Minister with: annual plans of action for the Foreign Intelligence Agency and reports on the Agency's activity;
     
  • in order to execute his tasks, cooperates with the Head of the Internal Security Agency, with due regard to the separation of powers between the Foreign Intelligence Agency and the Internal Security Agency and on the bases, within the scope, and according to the procedures specified by the Prime Minister;
     
  • in order to execute the tasks of the Foreign Intelligence Agency, within his competence and with the prior consent of the Prime Minister, may undertake cooperation with appropriate organs and services of other states;
     
  • participates in the sittings of the Committee for Special Services;
     
  • within his competence (the matters of the state's external security protection), immediately transfers to the President of the Republic of Poland and the Prime Minister information which might be significant to the security and international position of the Republic of Poland;
     
  • if obtained information concerns the matters falling within the scope of the activity of a competent minister, transfers that information to that minister, unless the Prime Minister decides otherwise;
     
  • receives from government administration organs information significant to the external security and international position of the Republic of Poland; that information is transferred to the President of the Republic of Poland, the Prime Minister, competent ministers, as well as the Head of the Internal Security Agency, within his competence;
     
  • specifies the circulation of information, including classified information, within the Foreign Intelligence Agency, and authorizes current and former functionaries and employees of the Foreign Intelligence Agency, as well as persons providing necessary assistance to them while performing intelligence activities, to disclose classified information to a particular person or institution;
     
  • is competent in the personal matters of the functionaries within the following scope: admission to service, appointment to posts, transfer to other posts, delegation, secondment, dismissal from posts, suspension in official duties, waiving suspension, dismissal from service, expiry of a service relation, as well as within the limited scope, nomination to ranks;
     
  • possesses the disciplinary power in relation to the functionaries of the Foreign Intelligence Agency, being competent to mete out punishment and grant distinctions; within the scope of petty offences proceedings is entitled to the prosecutorial powers of the Police resulting from the provisions of Petty Offences' Code;
     
  • is competent in other personal matters of the functionaries, particularly within the scope of: vesting the functionaries with the right to leave the state and to be the member of foreign or international organizations or associations, as well as taking decisions related to referring the functionaries to psycho-physiological examination.
