Foreign Intelligence Agency - The Head of the Foreign Intelligence Agency



Supervision by the Prime Minister over the activity of the Head of the Foreign Intelligence Agency who is directly subjected to the Prime Minister and the activity of the Foreign Intelligence Agency run by the Head is expressed, among other things, in the following instruments:
  • The Prime Minister directly supervises the activity of the Foreign Intelligence Agency as the service not covered by the scope of government administration divisions within the meaning of the Act of 4 September 1997 on Government Administration Divisions. This supervision may not infringe on the statutory powers of the Head of the Foreign Intelligence Agency in relation to the Agency run by him, whereas the scope of supervision is specified by the acts (in particular: the Act of 4 September 1997 on Government Administration Divisions and the Act of 24 May 2002 on the Internal Security Agency and the Foreign Intelligence Agency);
     
  • Executing the policy of the Council of Ministers, the Prime Minister lays down the binding guidelines and directions; however, they may not relate to the settlements concerning the essence of a matter dealt by the Head of the Foreign Intelligence Agency by means of an administrative decision;
     
  • The Prime Minister specifies the directions of the activities of the Foreign Intelligence Agency by means of guidelines;
     
  • In order to ensure required cooperation of Special Services (i.e. the Foreign Intelligence Agency, the Internal Security Agency, the Military Intelligence Service and the Military Counterintelligence Service), the Prime Minister may, after consultation with the Committee for Special Services, lay down the binding guidelines within this scope to the Head of the Foreign Intelligence Agency, in relation to the activity of the Agency run by the Head;
     
  • The Head of the Foreign Intelligence Agency, no later than within three months before the end of the calendar year, provides the Prime Minister with the plan of action for the Foreign Intelligence Agency for the following year;
     
  • The Head of the Foreign Intelligence Agency, no later than on 31 January, provides the Prime Minister with the annual report on the Foreign Intelligence Agency's activity for the previous calendar year.
